Terms of Service

These Terms of Service ("Terms") govern your use of PortAI's website at getportai.com and any phone line answered by a PortAI AI voice agent (collectively, the "Service"). By using the Service you agree to these Terms. If you don't agree, please don't use the Service.

PortAI provides an AI voice agent that answers inbound phone calls on behalf of the businesses we serve ("Clients"). When you call a PortAI- powered number, you may be speaking with an AI agent that books appointments, answers questions, and sends SMS messages on the Client's behalf.

You must be at least 18 years old to use the Service or have the consent of a parent or legal guardian.

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws.
• Attempt to disrupt, attack, reverse engineer, or interfere with the Service.
• Impersonate another person or misrepresent your identity.
• Send harassing, abusive, or fraudulent content to the Service or to recipients of messages sent through the Service.
• Attempt to circumvent rate limits, security controls, or opt-out mechanisms.

Calls answered by PortAI may be recorded and transcribed so that PortAI and the Client can serve you, deliver requested messages, maintain records, and improve the Service. If you do not consent to recording, please tell the agent and end the call, or contact the Client by another method.

Each Client is responsible for the content of its prompts, the accuracy of its business information, and its compliance with laws governing its industry (including SMS, advertising, privacy, healthcare, and any regulated-product rules that apply). PortAI provides tools; Clients direct how those tools are used.

The PortAI website, software, branding, and content are owned by PortAI and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. All other rights are reserved.

The Service relies on third-party providers for telephony, SMS delivery, cloud hosting, and AI infrastructure. We are not responsible for outages, delays, or failures caused by those providers or by your mobile carrier.

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. PortAI does not warrant that the Service will be uninterrupted, error-free, or accurate in every response.

To the maximum extent permitted by law, PortAI and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of or related to these Terms or the Service will not exceed one hundred U.S. dollars ($100).

You agree to indemnify and hold PortAI harmless from any claims, damages, or expenses arising out of your use of the Service or your violation of these Terms.

We may suspend or terminate access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms.

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law principles. The exclusive venue for any dispute is the state or federal courts located in Denver County, Colorado.

We may update these Terms from time to time. We'll update the "Last updated" date above and, when appropriate, notify Clients of material changes. Continued use of the Service after changes means you accept the updated Terms.
